Recent Changes to Landlord Tenant Law

RENT CONTROL PROPERTIES IN CITY OF LOS ANGELES

INCREASING RENT AND EVICTING FOR UNAUTHORIZED TENANTS UNTIL 3/01/24!

LANDLORDS IN LOS ANGELES MAY EVICT TENANTS WITH UNAUTHORIZED ADDITIONAL TENANTS OR INCREASE RENT AN ADDITIONAL 10% ONLY UNTIL MARCH 1ST, 2024!

Effective February 1, 2024, landlords can charge an additional 10% rent increase for each additional tenant brought into an RSO (rent controlled) unit before January 31, 2024 ONLY IF the number of tenants exceeds the initial number of tenants on the lease/rental agreement or who moved in initially. 

Additional Children

When counting the number of tenants for the purpose of applying this rule, that number does NOT increase for the first minor dependent child added to the tenancy (but twins and triplets are considered ONE child so no increase can be charged for twins or triplets). The second and third child CAN result in a 10% rent increase for each child (as long as they are not a twin or triplet with the first child).

Requirements for Rent Increase Prior to 3/01/24:

Rent increases for unauthorized additional tenants who moved in before January 1, 2024, must be done in writing on or before March 1, 2024

**If a 10% rent increase is implemented and thereafter the additional tenant  moves out, the landlord must decrease the rent by 10%. 

NOTE: A landlord cannot unreasonably withhold authorization of an additional tenant. 

Right to Evict Unauthorized Occupants before March 1, 2024

Unauthorized occupants who moved in before January 1, 2024 can also be evicted within this same window that expires March 1st, 2024. 

**However, note that the number of tenants does not increase for the purposes of this rule for the first minor dependent child added to the tenancy. 

**Landlords must comply with the notice requirements to take advantage of this law, such as a 30-Day Notice to Cure or Quit among other requirements.
